This Privacy Policy “Privacy Policy” applies to personal data submitted through S60’s application portal and related communications, interviews, assessments, diligence, and program administration.

<li>DEFINITIONS&nbsp;</li>
</ul>
Controller / Processor: S60 is the controller for application data; certain vendors act as processors on S60’s behalf.
Data: All information collected by S60 through the application process, including Personal Data, Sensitive Personal Data, and any other information provided by or about applicants, their companies, and related parties.
We/Us/Our:&nbsp;S60 SA LTD, and, where applicable, its affiliates acting in connection with the program and related activities described in this Privacy Policy.
PDP: Saudi Personal Data Protection Law and its Executive/Implementing Regulations.
Personal Data: Any data that, directly or indirectly, identifies a natural person.
Sensitive Personal Data: Personal data whose nature requires increased protection (e.g., health, genetic, biometric, credit, financial, religious, or location data), as defined by law.
You/Your: The individual applicant or authorized representative submitting an application through S60's application portal, participating in related communications, interviews, assessments, and program activities described in this Privacy Policy.

<li>WHAT WE COLLECT</li>
</ul>
We may collect: identification data (name, nationality, ID numbers where legally permitted), contact details, professional/education information, founder/team details, company and product information you submit (including high-level financial metrics), references, calendars/scheduling data, interview recordings, device and log data (IP address, timestamps), and any data you voluntarily include. We will collect limited categories of sensitive personal data where necessary for evaluation and compliance (e.g., national ID numbers or other identifiers as legally permitted). We apply heightened safeguards and strict data minimization when processing such data.

<li>HOW WE COLLECT</li>
</ul>
Directly from you via forms, uploads, emails, calls, or interviews. Automatically from devices when you use our site (cookies and similar technologies). See Cookies (Section 14) From third parties you authorize (e.g., references, mentors) and from public sources relevant to due diligence.

<li>PURPOSES OF PROCESSING</li>
</ul>
We process personal data to:
<ol style="text-align: justify;">
<li style="font-weight: 400;">receive, review, and evaluate applications (including due diligence, background/sanctions screening where lawful);</li>
<li style="font-weight: 400;">communicate with you regarding your application and the program; administer, operate, improve, and report on the program.</li>
<li style="font-weight: 400;">perform pre-contractual steps at your request and, if admitted, manage participation; ensure information security, detect/prevent fraud and misuse; and comply with legal and regulatory obligations and cooperate with competent authorities.</li>
</ol>
 
<ul style="text-align: justify;">
<li>LEGAL BASIS FOR PROCESSING</li>
</ul>
The Controller processes personal data in reliance upon the following lawful bases established under the PDPL: (i) consent of the data subject, where such consent has been freely given, specific, informed, and unambiguous for the designated processing purposes; (ii) the Controller's legitimate interests, including but not limited to program operations and enhancement, non-sensitive data analytics, and fraud prevention measures, provided such interests are not overridden by the fundamental rights and freedoms of the data subject; (iii) the performance of pre-contractual measures undertaken at the request of the data subject or the performance of contractual obligations where the data subject seeks program participation; and (iv) compliance with legal or regulatory obligations incumbent upon the Controller. With respect to sensitive personal data, the Controller shall obtain explicit consent from the data subject for specified processing purposes or, alternatively, rely upon such other lawful bases as are expressly permitted under the PDPL and its implementing regulations, with appropriate technical and organizational safeguards implemented to ensure enhanced protection of such data categories.

<li>SHARING AND RECIPIENTS</li>
</ul>
We may share personal data with:
<ol style="text-align: justify;">
<li style="font-weight: 400;">S60 affiliates (for evaluation, governance, and operations); </li>
<li style="font-weight: 400;">mentors, advisors, evaluators, and investment committee members supporting assessment and delivery;</li>
<li style="font-weight: 400;">service providers/processors (IT hosting, cloud, CRM, communications, analytics, background screening, data rooms, KYC/sanctions tools) under written data processing terms;</li>
<li style="font-weight: 400;">program partners (e.g., corporates, universities, co-investors) to evaluate applications and deliver the program; and</li>
<li style="font-weight: 400;">public authorities and counterparties where required by law or to protect rights. All recipients are bound by appropriate contractual and confidentiality safeguards consistent with PDPL and its regulations.</li>
</ol>
 
<ul style="text-align: justify;">
<li>YOUR RIGHTS</li>
</ul>
You may have certain rights regarding your personal data, which S60 will honor to the extent required by applicable law and where such requests do not interfere with our legitimate business interests, legal obligations, or program operations. Any rights requests must be submitted in writing to S60’s DPO with proof of identity. S60 reserves the right to deny requests that are unreasonable, repetitive, or would compromise others' privacy or our business operations.
<ul style="text-align: justify;">
<li>RETENTION</li>
</ul>
We will retain Data for a period of five (5) years from the date of collection, or from the end of our relationship with you, whichever is later, unless a longer retention period is required to satisfy any legal, regulatory, or reporting requirements. We may retain Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
To determine any extended retention period beyond the standard five (5) years for Data, we consider the amount, nature and sensitivity of the Data, the potential risk of harm from unauthorized use or disclosure of Data, the purposes for which we process Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, or other requirements.
After the applicable retention period has expired and it is no longer necessary to retain Data, we will securely delete it.
<ol style="text-align: justify;">
<li style="font-weight: 400;">SECURITY MEASURES</li>
</ol>
We maintain administrative, technical, and organizational measures appropriate to the risk, including access controls, encryption in transit and at rest where appropriate, vulnerability and patch management, vendor due diligence, and incident response.
<ol style="text-align: justify;">
<li style="font-weight: 400;">PERSONAL DATA BREACHES</li>
</ol>
If a breach occurs that may harm personal data or data subjects’ rights/interests, we will notify the competent authority and, where required, affected individuals without undue delay and in accordance with PDPL, its regulations, and published guidance. We will keep records of incidents, our assessment, and remedial actions.

<li>&nbsp;CHILDREN/MINORS</li>
</ul>
The program is not directed to minors. Do not submit applications for individuals under the age of 18 without lawful authorization from a parent/guardian. Where minors’ data is processed, we will apply heightened safeguards and consent procedures in accordance with PDPL.

<li>AUTOMATED DECISION-MAKING</li>
</ul>
We do not rely solely on automated decision-making to accept or reject applications; evaluations include human review. Automated tools may assist with screening and fraud/spam detection.

<li style="font-weight: 400;">COOKIES &amp; ONLINE IDENTIFIERS</li>
</ol>
The application portal uses only strictly necessary cookies for basic site operation and security; we do not use analytics or advertising cookies. Therefore, no separate Cookie notice or consent banner is presented. If our use of cookies changes, we will update this Privacy Policy.

<li>&nbsp;EXERCISING YOUR RIGHTS</li>

To exercise rights or raise questions, contact our DPO. We may request information to verify identity.

Where we engage processors, they act under our instructions, are bound by confidentiality, implement appropriate security, and may not engage sub-processors without our authorization. We maintain records of processing activities and conduct due diligence and audits as appropriate.

S60 designates a Personal Data Protection Officer as stated above who will be&nbsp; responsible for overseeing PDPL compliance, serving as the point of contact with the competent authority, and handling data subject requests.&nbsp;

We may update this Privacy Policy from time to time. Material changes will be highlighted and apply prospectively from the effective date. If required by law, we will seek your consent to material changes that affect how we process your data.

<li>LOCAL LAWS &amp; CONFLICTS</li>

If any part of this Privacy Policy conflicts with mandatory provisions of PDPL or other applicable KSA laws, those mandatory provisions will prevail.

To the maximum extent permitted under Saudi Arabian law, the site, portal, and program information are provided &quot;as is&quot; and &quot;as available.&quot; S60 and its affiliates expressly disclaim all liability for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages; loss of profits; loss of data; privacy or security incidents; or business interruption arising from or related to your application or these Terms. Any liability of S60 and its affiliates shall be limited to a reasonable amount as determined by applicable law for all claims in the aggregate, regardless of the cause of action or theory of liability.

<li>&nbsp;INDEMNITY</li>
</ul>
You will indemnify and hold harmless S60, its affiliates, and their directors, officers, employees, mentors, and advisors from losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or violation of law.

<li>THIRD-PARTY SITES &amp; SERVICES</li>
</ul>
Our site may include links or integrations to third-party services. We are not responsible for their content, terms, or privacy practices. Review those terms and policies before use.

<li>ASSIGNMENT</li>
</ul>
S60 may assign or transfer these Terms (in whole or in part) to an affiliate or in connection with a reorganization, merger, asset transfer, or similar transaction. You may not assign these Terms without S60’s prior written consent.

<li>GOVERNING LAW &amp; JURISDICTION</li>
</ul>
These Terms are governed by the laws of the Kingdom of Saudi Arabia. The competent courts in Riyadh, KSA, shall have exclusive jurisdiction over disputes arising out of or related to these Terms or the application.
<ul style="text-align: justify;">
<li>SEVERABILITY; WAIVER &amp; ENTIRE AGREEMENT</li>
</ul>
If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remainder will continue in full force and effect. No waiver is effective unless in writing. These Terms (including the Privacy Policy) constitute the entire agreement regarding the application, superseding all prior understandings on the same subject.

Notices to S60 should be sent to S60’s DPO. Notices to you may be sent to the email address provided with your application.

WHO WE ARE
The S60 Accelerator is operated by S60 SA LTD , a company registered under Commercial Registration No. 7051226368 with its registered office at P.O. Box 6888, Riyadh 11452, Kingdom of Saudi Arabia (&quot;S60,&quot; &quot;we,&quot; &quot;us,&quot; or &quot;our&quot;). We provide startup acceleration services and operate the S60 Accelerator program for qualifying Applicant.&nbsp;
These Terms &amp; Conditions (the &quot;Terms&quot;) govern your relationship with us when you submit an application to our accelerator program. By submitting an application, you (&quot;Applicant,&quot; &quot;you,&quot; or &quot;your&quot;) agree to be legally bound by these Terms and our Privacy Policy, which forms part of these Terms. If you do not agree to these Terms, please do not submit an application or use our services.
<ul style="text-align: justify;">
<li>ELIGIBILITY &amp; ACCURACY</li>
</ul>
You must satisfy the program eligibility criteria as posted on our site. If applying as a company or on behalf of a company, the applying entity must be a legally incorporated entity in good standing, and you must be duly authorized to submit the application and bind the company to these Terms. Individual Applicant must be at least 18 years old and have full legal capacity under Saudi law. Each entity (whether company or individual) may submit only one application per program cycle, unless otherwise specified by S60. Applications will be automatically disqualified under the following conditions: (a) incomplete or false information, (b) violation of local laws or regulations, (c) conflicts of interest, (d) submission of inappropriate or unethical content, (e) prior material breaches of S60 program terms. You warrant that all information you provide is true, accurate, and complete, and you will promptly update any material changes before a final decision is made. S60 may verify information and may reject, pause, or withdraw an application at any time for ineligibility or misstatement.
Applicant are required to promptly disclose any material changes to previously submitted information during the application process.
<ol style="text-align: justify;">
<li style="font-weight: 400;">CONFIDENTIALITY OF SUBMISSIONS</li>
</ol>
Application materials are not received in confidence, and Applicant expressly waives any expectation of confidentiality therein. S60 may use, share, and disclose all submitted information for evaluation, due diligence, program administration, reporting, and any other business purposes without restriction.
Confidential Information Definition: &quot;Confidential Information&quot; means only information that: (i) is specifically marked &quot;CONFIDENTIAL&quot; in bold, conspicuous lettering on each page by Applicant at the time of submission, (ii) constitutes genuine trade secrets under applicable law, (iii) is not otherwise publicly available or known to S60, and (iv) has been explicitly agreed to in writing by S60 as confidential through a separate confidentiality agreement executed prior to submission. All other submitted information, regardless of its sensitive nature, shall be deemed non-confidential.&nbsp;
Confidential Information expressly excludes: (a) any information that is or becomes publicly available through no breach by S60; (b) information known to S60 prior to disclosure; (c) information independently developed by S60 without reference to Applicant's materials; (d) information lawfully received from third parties without confidentiality restrictions; (e) information required to be disclosed by law, regulation, or court order; (f) information reasonably necessary for S60's business operations, program evaluation, or communications with investors, partners, or advisors; (g) business ideas, concepts, or methodologies; (h) financial projections or business plans; and (i) any information contained in pitch presentations or demonstrations.
Application materials may include: (a) detailed business plan; (b) pitch deck; (c) financial projections; (d) founding team biographies and qualifications; and (e) product/service prototype or demonstration. Applicant acknowledge that submission creates no fiduciary, advisory, agency, or confidential relationship between the parties.
S60 may share any submitted information (including any Confidential Information) with its affiliates, employees, advisors, mentors, investors, program partners, service providers, and other third parties without obtaining prior consent from Applicant. Applicant remains solely responsible for determining what information to submit and assumes all risks associated with disclosure of any materials provided during the application process.
<ul style="text-align: justify;">
<li>NO OFFER &amp; NO INVESTMENT ADVICE</li>
</ul>
Submission is not (i) an offer or solicitation to buy or sell securities, (ii) investment advice, or (iii) a promise to admit you to the program or to invest. Any investment, grants, or participation will be governed solely by definitive written agreements executed at a later stage. These agreements may include requirements or restrictions regarding future funding rounds, which will be disclosed in detail at that time.
<ul style="text-align: justify;">
<li>SELECTION &amp; DISCRETION</li>
</ul>
S60 will evaluate applications based on criteria that will be communicated to Applicants via email. Details regarding mentorship and advisor sessions, including frequency, duration, and expected time commitments, will be provided to selected participants via email. Applicant will be notified of their status via email to the contact address provided in their application. S60 may evaluate, shortlist, request interviews, conduct due diligence, and select Applicant in its sole discretion. During the evaluation process, S60 reserves the right to request additional information, documentation, or clarification from Applicant as needed. Response timeframes for any due diligence requests will be specified in the communication requesting such information. S60 may modify, suspend, or cancel the application process or program at any time without liability. S60 has no duty to provide individual feedback.
<ul style="text-align: justify;">
<li>INTELLECTUAL PROPERTY</li>
</ul>
You retain ownership of your pre‑existing intellectual property. You grant S60, its affiliates, mentors, advisors, and service providers a non‑exclusive, worldwide, royalty‑free license to use, reproduce, display, and distribute your submitted materials solely to evaluate your application, conduct due diligence, and administer the program. For any derivative works or improvements developed during the application process, ownership shall remain with the Applicant. However, S60 shall receive a non-exclusive, perpetual license to use such derivative works or improvements for program evaluation, research, and internal purposes, without additional compensation. This license and any associated IP protections will remain in effect for the duration of the application process and program participation, plus an additional 12 months thereafter. Any confidentiality obligations agreed upon in separate written agreements will remain in effect as specified in those agreements.
<ul style="text-align: justify;">
<li>PUBLICITY &amp; USE OF MARKS</li>
</ul>
If admitted, you consent to S60 using your name, logo, and a factual description of your company and participation for programming publicity. You may reference your application or participation in a truthful, non-misleading manner in accordance with S60 brand guidelines. Each party retains its trademarks and goodwill.
<ul style="text-align: justify;">
<li>CONDUCT &amp; COMPLIANCE</li>
</ul>
You agree not to submit unlawful, infringing, defamatory, or misleading content and not to misuse the site (including introducing malware, scraping, circumventing access controls, or interfering with site operation). You will comply with applicable laws to the extent required by Saudi law, including but not limited to principles related to anti-bribery, anti-money laundering, sanctions, and export controls as may be relevant to the Program's activities, and you will not offer, give, solicit, or receive any bribe or improper advantage in connection with the application or the program.
 
<ol style="text-align: justify;">
<li style="font-weight: 400;">REPRESENTATION AND WARRANTIES&nbsp;</li>
</ol>
You represent and warrant to S60 that: (a) you have full corporate power and authority (or, if an individual, legal capacity) to enter into these Terms and perform your obligations hereunder; (b) if applying on behalf of a company, you are duly authorized by such company to execute these Terms and bind the company; (c) these Terms constitute a legal, valid, and binding obligation enforceable against you in accordance with their terms; (d) all information, data, and materials you submit in your application and during the evaluation process are true, accurate, complete, and not misleading in any material respect; (e) your submission and participation will not violate any applicable laws, regulations, or third-party rights; (f) you own or have sufficient rights to all intellectual property, content, and materials submitted in your application; (g) your submitted materials do not and will not infringe, misappropriate, or violate any intellectual property rights, privacy rights, or other proprietary rights of any third party; (h) you are not subject to any sanctions, export restrictions, or other prohibitions that would prevent participation in the program; (i) there are no pending or threatened legal proceedings that would materially affect your ability to participate in the program; and (j) you have disclosed all material conflicts of interest and will promptly notify S60 of any conflicts that arise during the application process or program participation.
<ul style="text-align: justify;">
<li>GOVERNING LAW AND JURISDICTION</li>
</ul>
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia.
<ul style="text-align: justify;">
<li>SEVERABILITY</li>
</ul>
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, such provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification or deletion of a provision under this clause shall not affect the validity and enforceability of the rest of these Terms. The parties agree that the courts should endeavor to give effect to the parties' intentions as reflected in the original provision to the greatest extent possible.
 
<ul style="text-align: justify;">
<li>PLATFORM AVAILABILITY &amp; CHANGES TO TERMS</li>
</ul>
The site and application portal are provided “as available&quot; subject to scheduled maintenance and technical requirements. S60 shall not be liable for any temporary unavailability of the platform. We may update these Terms from time to time by posting a revised version with a new “Last updated” date. Material changes apply to applications submitted after the effective date.
